as per google:
quote:
What is the difference between ‘no-fault’ and ‘at-fault’ ?
Often, the laws of the state in which the accident occurs determines who pays for the damages incurred in an accident. About half of the states in the US have adopted so-called "no-fault" liability laws. Under a no-fault system of law, it does not matter who was "at-fault" or "caused" the accident. No-fault states adopt the approach that everyone is to "make themselves whole" after incurring damages as a result of an auto accident. By making everyone responsible for his or her own loss, states hope that the number of lawsuits will be reduced, since liability does not have to be determined.

quote:
In a pure "at-fault" state, the person who caused the auto accident is responsible for payment of all of the damages sustained by everyone involved. The theory in an at-fault state is that the person (or people) who caused the loss must make everyone else whole again, thus everyone is held accountable for the results of his/her actions. In "at-fault" states, courts (through lawsuits) are often called upon to resolve the issue of whom is the at-fault person and will be the one to pay for all damages.

In Michigan (a no-fault state) if you have the proper coverage you never pay a thing if it is not your fault. Your insurance company pays for your repairs and the other person's insurer pays for their repairs. Only the person at fault pays a deductible.

Well I'm still waiting for the Police Accident Report. Last time I was in an accident, I had that report the next day.

I'm on day three waiting for this thing now. I want to get the damn ball rolling already. I'd imagine I'll have to pay my deductable again ($1000). Fucking pain in my ass.

If it's proven to be her fault you should have to pay a thing unless you don't have proper coverage.

Normally with no fault insurance, your insurance company pays for your repairs and her insurance company pays for hers. Whoever is at fault pays their deductible and it's waived for who is not at fault.

Well the adjuster is going to look at my car today. Its the adjuster from her insurance company. They might end up paying for everything anyway because I think they're afraid of a lawsuit considering she ran the light.

To be continued... In other news, my back kind of hurts since last night. Its probably unrelated, but hey I might use it as an excuse to go see the doctor and get more money.

Ok I found out how it works in Michigan.

If you have basic collision then you pay the deductible even if it is not your fault. You can go after the person at fault's insurance or the actual person to get back your deductible.

If you have broad collision then you only pay the deductible if you are at fault.

I have broad collision.

So the Adjuster for Progressive (the woman's insurance company) asks to see my car at the autobody shop. (Usually, when they want to see it, they are planning to take the claim)

So they go to the guy at the autobody shop (also a family friend) and say they want to take a look at the car. So the guy is like "So you're taking the claim?" and the adjuster says no, we just want to see the car. He told them to get the hell out of there because if they aren't taking the claim there's no need for them to see anything. Fucking joke.

So I'll have to go through State Farm, pay the deductable, and hope State Farm gets some money back from me though Progressive in the future.

I don't get it...I am in New York and anytime there's an accident the person who's at faults insurance company pays for it. Especially in a case where someone runs a red light. How could they claim that's your fault or no fault?

To be completely honest, I'm not sure. I need to check into it.

Josh: I think the laws in the city is different from the rest of the state. It's all fucked up.
